Complaint Policy & Procedures

This policy outlines our complaint procedures. If you are a user of http://www.members.nerdballertv.com/ (“Website”), this policy forms part of your agreement with us.

1. Applicability

Whether or not you are a user, you can use this policy to alert us to any complaint that you have relating to the Website.

2. How to Make a Complaint

If you have a complaint about the Website (including any complaint about content appearing on the Website or the conduct of a user), please send your complaint to compliance@nerdballertv.com, including your name, address, contact details, a description of your complaint, and, if your complaint relates to content, the URL for the content to which your complaint relates. If you cannot contact us by email, please write to us at the mailing address identified in section 7. Alternatively, we have a form you can submit the complaint as well at https://form.jotform.com/241528654469063

3. Complaints of Illegal or Non-Consensual Content

After receiving your complaint of illegal or non-consensual content under section 2:

  • We will take appropriate steps to investigate your complaint within seven business days.
  • If we require further information or documents from you, we will contact you to let you know.
  • If we determine that the content is unlawful or non-consensual, we will immediately remove that content, report it to Segpay and relevant authorities as necessary, and notify you of our decision by email or other electronic message.
  • If we determine that the content is not unlawful or non-consensual, we will notify you of our decision by email or other electronic message.

Appeal Process: If you believe you were depicted in content without your consent, you may appeal our determination. In such cases:

  • We will confirm that we obtained appropriate consent for the content.
  • If we cannot establish appropriate consent, we will take down the content immediately.
  • If you demonstrate that consent is void under applicable law, we will also remove the content immediately.
  • If we disagree that the consent is void under applicable law, we will allow the disagreement to be resolved by a neutral arbitration body at our expense.

4. Complaints of Copyright Infringement

Complaints related to copyright infringement must be submitted to our copyright agent in accordance with our DMCA Policy, and we will respond to copyright infringement complaints as set out in that policy.

5. All Other Complaints

After receiving any other complaint (including complaints related to other breaches of the Terms-of-Service Agreement or the Seller Agreement) under section 2:

  • We will take appropriate steps to investigate your complaint within a timeframe that matches the nature of your complaint.
  • If we require further information or documents from you, we will contact you to let you know.
  • We will take appropriate actions in good faith to address the issue raised by your complaint. If you have complained about content that appears on the Website and we determine that the content breaches the Terms-of-Service Agreement or the Seller Agreement, we will act promptly to remove that content.
  • We will notify you of the outcome of your complaint, including the actions taken.

6. Unjustified or Abusive Complaints

If you are a user, you agree not to make any complaint under this policy that is wholly unjustified, abusive, or made in bad faith. If we determine that you have breached this warranty, we may suspend or terminate your user account.
